TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the fiber internet services ("Services") provided by HTZ Fiber ("HTZ Fiber," "we," "our," or "us"). By subscribing to or using our Services, you ("Customer," "you," or "your") agree to be bound by these Terms. Please read these Terms carefully before using our Services.

1. ACCEPTANCE OF TERMS

By accessing or using HTZ Fiber Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree to these Terms, you may not use our Services.

2. SERVICE DESCRIPTION

HTZ Fiber provides high-speed fiber-optic internet services at various speed tiers, including 500 Mbps, 1 Gig (1000 Mbps), and 2 Gig (2000 Mbps) plans. Services are subject to availability in your area. Actual speeds may vary based on network conditions, equipment, number of connected devices, and other factors beyond our control.

3. ELIGIBILITY AND ACCOUNT REGISTRATION

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to subscribe to our Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. PRICING AND PAYMENT

Pricing

Service pricing is based on the plan you select and your service location. All prices are subject to change with thirty (30) days' notice. Pricing includes a discount for enrollment in automatic payment (AutoPay). If you choose not to enroll in AutoPay, an additional fee of $5.00 per month will apply. A paper statement fee of $5.00 per month applies if you request paper billing statements.

Billing and Payment

You agree to pay all charges associated with your account, including monthly service fees, equipment fees, installation fees, late fees, and any applicable taxes. Payments are due on the date specified in your billing statement. If payment is not received by the due date, a late fee may be applied, and your Services may be suspended or terminated. You authorize HTZ Fiber to charge your designated payment method for all applicable fees.

Installation

Standard installation is included at no additional charge. Additional fees may apply if your residence is located more than 250 feet from the fiber network connection point, or if special installation requirements are needed.

5. EQUIPMENT

HTZ Fiber may provide or require certain equipment, including routers, modems, and other networking devices, for you to access the Services. Equipment provided by HTZ Fiber remains our property and must be returned in good condition upon termination of Services. You are responsible for any damage to or loss of HTZ Fiber equipment. You may use your own compatible equipment, but HTZ Fiber does not guarantee compatibility or provide technical support for customer-owned equipment.

6. SERVICE AVAILABILITY AND LIMITATIONS

While we strive to provide reliable, uninterrupted service, HTZ Fiber does not guarantee that the Services will be available at all times or that they will be error-free. Service may be temporarily unavailable due to maintenance, upgrades, technical difficulties, force majeure events, or other factors beyond our control. HTZ Fiber is not liable for any interruption, delay, or failure of service.

Advertised speeds represent maximum potential speeds under optimal conditions. Actual speeds may vary and are not guaranteed. Factors affecting speed include network congestion, equipment limitations, wireless interference, number of connected devices, and the performance of websites or services you access.

7. ACCEPTABLE USE POLICY

You agree to use the Services in compliance with all applicable laws and regulations and in accordance with our Acceptable Use Policy. Prohibited activities include, but are not limited to:

Using the Services for any illegal purpose or to transmit illegal content
Transmitting spam, malware, viruses, or other harmful code
Attempting to gain unauthorized access to our network or other systems
Interfering with or disrupting the Services or network security
Reselling or redistributing the Services without authorization
Using the Services in a manner that violates the rights of others
Engaging in copyright infringement or other intellectual property violations

Violation of the Acceptable Use Policy may result in suspension or termination of your Services without refund.

8. INTELLECTUAL PROPERTY

All content, trademarks, logos, and materials on the HTZ Fiber website and related to the Services are the property of HTZ Fiber or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, distribute, or create derivative works from any HTZ Fiber content without our express written permission.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HTZ FIBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF HTZ FIBER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

HTZ Fiber's total liability to you for any claims arising from or related to the Services shall not exceed the amount you paid to HTZ Fiber for the Services during the twelve (12) months preceding the claim.

10. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HTZ FIBER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. TERM AND TERMINATION

Term

These Terms begin when you subscribe to the Services and continue on a month-to-month basis unless otherwise specified in your service agreement.

Termination by Customer

You may cancel your Services at any time by contacting customer support at 1-888-556-7493 or [email protected]. Cancellation will be effective at the end of your current billing period. You remain responsible for all charges incurred up to the cancellation date. Equipment provided by HTZ Fiber must be returned within thirty (30) days of cancellation.

Termination by HTZ Fiber

HTZ Fiber may suspend or terminate your Services immediately, without notice, if you violate these Terms, fail to pay amounts due, or engage in conduct that we reasonably believe is harmful to our network, other customers, or our business. Upon termination, you must immediately cease using the Services and return all HTZ Fiber equipment.

12. DISPUTE RESOLUTION

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Cleveland, Ohio. You and HTZ Fiber agree to waive the right to a jury trial and to participate in a class action lawsuit.

13. MODIFICATIONS TO TERMS

HTZ Fiber reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new effective date and, when required, by sending you an email or other notification. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you may cancel your Services as described in Section 11.

14. PRIVACY

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless HTZ Fiber, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another party.

16. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and HTZ Fiber regarding the Services and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.
